Description / الوصف

It is known that rulings, which are branches, only differ due to differences in the foundational principles and rules upon which they are based. Induction has shown that disagreements in the branches of jurisprudence can be attributed to disagreements in the general principles and foundational rules relied upon in legal reasoning. This category encompasses all those reasons where the disagreement ultimately stems from differences in comprehensive principles. Additionally, some disagreements arise from differences in the applicability of the foundational principles and rules to the branches, even when there is agreement on the principle itself. This category encompasses all those reasons where the disagreement relates to differences in refining the legal cause (مناط) of the case, verifying it, or deriving rulings from it. 43- نزهة الطرف في بيان أسباب الظرف
